Lessig explains very clearly why the current copyright system is flawed and proposes some interesting changes (both for "you" as user and content creator, and for "them" the law system). All extremes are carefully avoided: Lessig manages to be credible, to explain the problem and to convince you of how wrong "eternal" copyright could be.
      Very interesting. Recommended!

      書本名稱的Free﹐並不是免費的Free﹐而是指自由的Fre e。作者從知識產權演變的歷史說起﹐從最初版權法只有十四年期﹐ 後來貪得無厭的版權商大灑金錢遊說國會﹐多次修改法例不斷延長年 期至九十九年﹐從本該屬公眾知識中搾取最後一分一毫。書中亦舉出 很多版權商為謀取暴利﹐運用法律手段運操弄知識產權法﹐作出完全 違背知識產權鼓勵傳揚知識的立法精神的行為。當年RCA公司為保 護AM收音機的市場壟斷﹐利用專利法阻止更新更好的FM收音機技 術推出市場。有記錄片導演為求真實性﹐要借用某電影內數十秒片段 ﹐卻被坐擁版權電影公開天殺價。有書評批評某本書內的錯誤﹐卻原 作者以版權法禁止引用原文。有公司推出回顧奇連伊士活演藝生平的 DVD﹐結果要用三年時間和大量資源﹐才從各大小電影公司中買齊 版權﹐避免誤踏知識產權法的地雷陣。

      作者畢竟是名牌大學的法律教授﹐他在書有很詳盡的篇幅﹐解釋法律 的基礎理論﹐從而推論知識產權與一般產權的分別。在社會中市民能 不能做一件事情﹐主要受限於四個條件。物理條件的限制﹐沒有船便 不能過海。經濟條件的限制﹐過海渡小輪不乎合成本效益﹐所以沒有 公司營運。法律條件的限制﹐政府把海的對岸橫為禁區﹐平民不得乘 船渡海。社會典範的限制﹐在公共交通上挖鼻孔﹐會被四週的乘客鄙 視。新科技可以改變物理和經濟條件﹐而民意也會影響社會典範﹐法 律更往往是利益團體政治交易的結果。作者指出現行接近無限期的版 權法﹐是版權商運用法律力量壓倒科技﹐經濟和社會典範的結果。留 聲機﹐影印機和錄音機﹐早已為知識產權帶來多次洗牌效應。互聯網 和新媒體的出現﹐新一代接受分享下載﹐抗拒讓版權商藉壟斷抬高價 值﹐只不過是知識產權發展踏入一個新階段。新科技的出現會帶來新 的改變﹐既得利益者必然為保利益誓死反抗﹐不惜與社會大多數人的 利益作對。

      現行的知識產權法極不平衡﹐嚴重偏袒版權商人一方﹐公平使用條款 形同虛設﹐妄顧社會大眾的利益﹐亦損害知識產權的立法原意。現在 的版權法扼殺創和文化自由﹐知識要事先申請準許才能使用﹐而版權 合約法律異常複雜﹐徒然使律師從中獲利增加交易費用。消費者要付 出額外開支﹐創作人則毫無得益﹐只肥了當中間人的版權商和寄生於 版權法上的律師。作者深明現存制度的漏洞與禍害﹐書中記錄了他入 稟最高法院﹐要求推翻國會增訂版權法的官司﹐可惜最終因為法律上 的技術問題而敗訴。他提出改革知識產權制度的建議﹐希望喚醒公眾 的關注﹐以社會政治運動的方式﹐去實現知識產權法律的改革。

      他認為版權需要登記才有效﹐集中管理方便聯絡持有人﹐正如專利﹐ 汽車或房屋這些重要產權一樣。縮短版權獨市壟斷的年期﹐讓知識早 日開放給公眾使用﹐ 並設立登記續期的制度。若版權持有人不願意付出數十分鐘續期的時 間和登記的費用﹐那倒不自動放棄版權。設立幅蓋所有版權的一籃子 使用機制﹐讓使用的人先使用後才定額付款。大幅簡化版權合約的程 序﹐像現在電台播歌RIAA代收版稅的制度一樣。最重要是精簡知 識產權法律﹐減少麻煩的法律文件和杜絕當社會寄生蟲的律師。

      作者既然反對藉版權謀取暴利﹐這本書以開放版權發放﹐讀者可以免 費下載電子書版本﹐亦可以上網收聽由志願人士朗讀的有聲書版本。 當然無書在手不歡的朋友﹐也可以到書局購買傳統的紙張版本。我上 網訂購這本書時﹐書店弄錯訂單寄了兩本書來﹐結果我書櫃多出一本 Free Culture。我打算把多出來的這本書送給有興趣的朋友﹐若想 取書請和我聯絡取書方法。

    • A serious study on the detrimental effects of the excesses of copyright protection on our culture, including a brief history of copyright in the US and hints at several possible solutions that would help promote a free culture without depriving content creators of their due.

All creative works-books, movies, records, software, and so on-are a compromise between what can be imagined and what is possible-technologically and legally. For more than two hundred years, laws in America have sought a balance between rewarding creativity and allowing the borrowing from which new creativity springs. The original term of copyright set by the Constitution in 1787 was seventeen years. Now it is closer to two hundred. Thomas Jefferson considered protecting the public against overly long monopolies on creative works an essential government role. What did he know that we've forgotten?

Lawrence Lessig shows us that while new technologies always lead to new laws, never before have the big cultural monopolists used the fear created by new technologies, specifically the Internet, to shrink the public domain of ideas, even as the same corporations use the same technologies to control more and more what we can and can't do with culture. As more and more culture becomes digitized, more and more becomes controllable, even as laws are being toughened at the behest of the big media groups. What's at stake is our freedom-freedom to create, freedom to build, and ultimately, freedom to imagine.
